The high court of jammu and Kashmir was established in 1961, following the enactment of the Constitution of jammu and Kashmir in 1957 . Before that, the region's judicial system was controlled by the Maharaja and the court followed a mix of customary law and principles from British colonial rule. After jammu and Kashmir's accession to india in 1947 . The region's legal system gradually aligned with Indian laws, but it retained special provisions under Article 370 of the indian Constitution of jammu and Kashmir.
The High court of jammu and Kashmir become the highest judicial authority for the state. Exercising jurisdiction over legal and constitutional matters. It operated independently Interpreting both state law and indian lawa with in the context of the region's special status. The courts decisions were binding within the state and had exclusive jurisdiction over legal disputes.
The major shift came in 2019 when the government of india abrogated Article 370 effectively revoking jammu and Kashmir special status and Bifurcating in into two union territories..... Jammu and Kashmir and ladakh.
This change led to the integration of the region's judicial system with the rest of india. The High court now functions as the highest legal authority for jammu and Kashmir applying both indian and local laws and serves as a key institution in the Union territory.
Full fledged High court in 1928.
First when the highest authority of ruler of the state in 1989 Maharaja Pratap singh has set council and said British government to Appoint council and judicial members of the council.
But acted under control of the law minister of the council.
And after that the council was abolished then ministers designated as the judge of the high court.
In 1927 new Constitution sanctioned by Ruler of the state
The high court was established by virtue of order no 1 dated 26 March 1928. A ministry in the judicial department was created.
